Child Support is very often involved as a part of a divorce. Keep in mind that courts award child support outside of marriage as well. Virginia uses a statutory guideline for determining baseline child support, also aptly called “guideline child support.” The guidelines take into account the combined and relative incomes of the parents, work-related child care and day care paid by either or both parents, and health care premiums paid by either or both parents. There are also different ways to calculate guideline support based on sole custody, primary custody, and shared custody. What the guidelines don’t take into account are special circumstances. When special circumstances exist, a deviation from the guidelines may be necessary.
